INTRODUCTION

  1. This regulation defines the rules for providing Services by the Service Provider, the rights and obligations of the Service Provider and Service Recipients related to the provision of hotel services and additional services, the rules for protecting personal data of the individuals using them, and the rules for excluding the liability of the Service Provider for the provision of Services.
  2. The regulation has been posted by the Service Provider on the Service Provider's websites in a manner that allows acquiring, reproducing, and saving the content of the Regulation using the teleinformatics system used by the Service Recipient.

I. General Provisions

  1. Terms used in this Regulation mean:
    1. Teleinformatics system – a set of cooperating IT devices and software that ensures processing and storing, as well as sending and receiving data through telecommunications networks using an appropriate terminal device for a given type of network within the meaning of telecommunications law,
    2. Distance contract – a contract concluded with a consumer within an organized system for concluding distance contracts, without the simultaneous physical presence of the parties, exclusively using one or more means of distance communication until the conclusion of the contract inclusive,
    3. Electronic communication means – technical solutions, including teleinformatics devices and cooperating software tools, enabling individual communication at a distance using data transmission between teleinformatics systems, especially electronic mail,
    4. Service Provider – Zamek Giżycki Sp. z o.o., ul. Św.     5. Service Recipient – an entity being a natural person, legal person, or organizational unit without legal personality, using the services of the Service Provider, the Service Recipient may simultaneously be a Guest,
    6. Guest – a person using hotel services or additional services offered by Hotel ST. Bruno. This person may simultaneously be a Service Recipient,
    7. Registration form – an online form placed on the Service Provider's websites, used to register the Service Recipient in the system,
    8. Online reservation – reservation of hotel services made in the system in real-time using the booking engine (Internet Booking Engine) available on the page http://www.hotelstbruno.pl,
    9. Authorization document – a document specifying the detailed terms of reservation, including data on the length of stay, amount due for the stay, and the deadline for the deposit payment for the stay at the Hotel.
  2. Before using the services provided by the Service Provider, including using the website and the booking engine, the Service Recipient is obliged to read this Regulation and confirm acceptance of its terms.

II. How to Make a Reservation

  1. To make an online reservation via the teleinformatics system used by the Service Provider, it is necessary to use commonly used web browsers.
  2. Proper use of the services provided by the Service Provider via the Teleinformatics Service is possible after enabling the "cookies" option and disabling pop-up blocker in the web browser used by the Service Recipient.
  3. The Service Provider provides services to the Service Recipient within the scope and under the conditions specified in this regulation.
  4. The Service Recipient agrees to comply with these regulations.
  5. The Service Provider reserves the right to carry out maintenance work on the teleinformatics system that may cause temporary difficulties or prevent Service Recipients from using the Teleinformatics Service.
  6. Reservations can be made through:
    1. the Hotel’s website and booking engine (Internet Booking Engine) located on the Service Provider's website,
    2. filling out and signing a reservation form on the Hotel’s website and sending it to the Hotel electronically,
    3. submitting an order for a stay at the Hotel in writing, by fax, or electronically (email),
    4. making a telephone reservation,
    5. personal, written confirmation of reservation at the Hotel Reception, i.e., a direct "walk-in" reservation.

III. Reservation Process

  1. Online reservation is made by following the steps recommended by the automatic reservation system, filling out the registration form, and making the required payment.
  2. The Service Recipient is fully responsible for the consequences resulting from providing incorrect data in the forms.
  3. Prices shown in the system are per room per one hotel night or per one person-day and include VAT. They may also include other services specified in the offer description. If the offer includes breakfast or other additional services, such information is provided in the price description shown during the booking in the system. For services not covered by the order (e.g., additional catering or SPA services), payment must be made on the spot by the Guest.
  4. The currency unit is the Polish złoty (PLN).
  5. In case of payment by bank transfer, all fees for its execution shall be borne by the Service Recipient.
  6. After making a reservation as specified in part II item 6 letters b-d above, the Hotel will send to the address, email, or fax number indicated by the Service Recipient an Authorization Document specifying the validity of the offer and the amount of the required deposit for the reserved stay.

IV. Price for hotel services and additional services

The price list for accommodation services/rooms/stay packages of Hotel St. Bruno is available on the Hotel St. Bruno website www.hotelstbruno.pl, containing prices valid on the date of making the reservation and in the so-called booking engine also available on the Hotel St. Bruno website. Prices available on the Hotel St. Bruno website are quoted per room per one hotel night with breakfast (booking engine) or for a so-called stay package (prices and packages), including the price with breakfast, dinner with additional SPA services or without them. Prices may also include other services specified in the offer description. If the offer includes breakfast or covers other additional services, such information is provided in the price description displayed in the system during the reservation or in the Authorization Document sent to the Service Recipient. The price list for catering services and beverages is available in the hotel’s Biblioteka Restaurant and hotel club.

V. Payments and Invoice Issuance

  1. Payments are made directly during the online reservation process. If payment is a condition for its confirmation, the Service Recipient will be informed about it. The reservation is considered made only after the prepayment (deposit) in the amount set by the hotel has been made. The amount of the prepayment is specified in the price offer conditions.
  2. The Service Recipient booking a hotel room may pay the deposit mentioned above in the form of a bank transfer, e-transfer, cash, or by charging a credit card with the Service Recipient's written consent.
  3. The deposit must be paid within the deadline specified in the Authorization Document.
  4. Credit card authorization and payment settlement are handled by an external entity through a direct connection to the payment card clearing agent's server.

  6. The Service Provider issues VAT invoices according to the applicable tax law regulations in Poland.
  7. In the case of a personal hotel room rental directly at the Hotel Reception (the so-called direct walk-in reservation), the Hotel reserves the right to preauthorize the credit card at check-in or directly charge the credit card if payment for the stay is to be made using a credit card. If payment is made in cash, the amount for the stay is paid in advance. In such cases, the "deposit" form does not apply.
  8. The billing period at Hotel St. Bruno is seven days, which means that every Service Recipient who books a stay longer than 7 days is obliged to settle payment for the used stay and services within 7 days from the start date of the stay. The Service Provider reserves the right, in justified cases, to request an increase in the credit card security deposit or payment for the stay in the Hotel earlier.
  9. The use by the Service Recipient of additional hotel services based on the so-called "Hotel credit" allowing credit orders ("room account") for services accompanying the guest's stay may only occur after providing the Hotel Reception with the guest's credit card number with its expiry date along with the guest's consent to its charge or preauthorization. "Hotel credit" can also be opened in case of placing a cash deposit at the Hotel reception – up to the amount of the deposit. The billing of ordered hotel services is done according to the Hotel Price List and/or Special Offers valid on the date the order is made.

VI. Reservation confirmation

  1. A reservation is considered made when the online booking system generates a reservation confirmation number or when the guest receives written confirmation from the Hotel Reception, subject to the provisions of points VI b-d below.
  2. A reservation is considered confirmed when the Service Recipient makes a prepayment for the stay in the Hotel, according to the declared duration of stay. The prepayment for the stay can be made in cash, bank transfer, or by charging the credit card with the Guest's consent.
  3. Additionally, the online reservation system automatically generates a confirmation sent via email to the Service Recipient's address provided in the form.
  4. Failure to pay the deposit by the deadline specified in the Authorization Document is considered a withdrawal by the Service Recipient from the hotel services reservation and results in the assumption that no effective contract for hotel services has been concluded between the parties.

VII. Terms for changes and cancellations of reservations

Exceptionally – with the written consent of the Service Provider – it is possible to change or cancel a reservation but only for important reasons justified and documented by the Guest in writing under the conditions specified below, unless the terms for changes and cancellations in the reservation confirmation of the given offer stipulate otherwise.

Cancellation terms:

In case of cancellation of the reserved stay, the Guest will be charged a cancellation fee in the amount of:

  1. Free of charge if cancellation is made 25 days or more before the planned arrival
  2. 50% of the value of the reserved stay if cancellation is made between 25 and 8 days before the planned arrival
  3. 100% of the value of the reserved stay if cancellation is made less than 7 days before the planned arrival or no-show without canceling the reservation.

The difference between the payment made for the reservation and the cancellation fee (if applicable) will be refunded to the Service Recipient by bank transfer to the account specified by them.

The cancellation fee will be deducted from the deposited deposit or from the paid stay amount, or charged to the credit card. A separate invoice will be issued for the remaining part of the cancellation fee (if any) and sent to the Guest's correspondence address.

The cancellation request may be submitted in writing, by fax, or by email.

Regarding reservations during periods of particular interest, Hotel St. Bruno reserves the right to introduce different cancellation conditions in the Authorization Document or even completely exclude the possibility of submitting a cancellation request.

VIII. Terms of entering into and terminating contracts

  1. The terms of entering into and terminating contracts for providing hotel services by the Service Provider are exhaustively specified in this regulation; apart from these cases, termination of the contract is possible only by mutual agreement made in writing under penalty of nullity.
  2. The Service Recipient has no right to withdraw from the hotel service reservation contract under Article 38 point 12 of the Act dated May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827) ("Consumer Rights Act").

IX. Personal data protection

  1. Through the website www.hotelstbruno.pl, data is collected by filling out forms. The form contains mandatory fields necessary to complete and optional fields that the Service Recipient may fill out. The data entered in the form are processed for the purpose resulting from the function of the specific form.
  2. Data is stored and processed by the Service Provider on the terms specified in the Personal Data Protection Act and the Act on providing services by electronic means.
  3. The Service Recipient has the right to access the contents of their data and to correct, change, and delete it.
  4. Providing personal data by the Service Recipient is entirely voluntary, however refusal to provide it in specified cases may prevent the conclusion of a contract.
  5. The Service Provider informs that based on art. 23 sec. 1 point 3 of the Personal Data Protection Act, it has the right to process the Service Recipient's personal data according to and within the scope specified in the aforementioned act for purposes connected with online reservations at Hotel St. Bruno in Giżycko. The Service Provider will receive such information via registration or logging into the system.
  6. Administrator of personal data is: Zamek Giżycki Sp. z o.o., ul. św. Brunona 1, 11-500 Giżycko, NIP: 739-358-18-93, REGON: 280145402, operating Hotel ST Bruno in Giżycko, ul. Św. Brunona 1,11-500 Giżycko, Poland, Giżycko county, Warmian-Masurian voivodeship. The Service Recipient has the right to view and correct their personal data.

X. Complaint procedure

  1. Complaints may be filed due to:
    1. Failure by the Service Provider to meet the agreed service start date under the contract,
    2. Non-performance, improper performance of services, or incorrect billing of services.
  2. Complaints can be submitted within 14 days from the day the service was performed or supposed to be performed.
  3. The complaint should:
    1. be submitted to the Service Provider's office address or by email to recepcja@hotelstbruno.pl,
    2. contain the reason for the complaint and specify the Service Recipient’s demand,
    3. be signed and include current Service Recipient's data.

XI. Transitional and final provisions

  1. Matters not regulated by this regulation shall be governed by the provisions of the Civil Code (consolidated text Journal of Laws 2017, item 459), the Act on providing services by electronic means (consolidated text Journal of Laws 2016, item 1030 with amendments), and other universally applicable laws.
  2. The Service Provider reserves the right to make changes to this Regulation provided that the version of the Regulation applicable at the time of the order by the Guest is used for reservations made before the change.
  3. Date of publication of the regulations: 06.10.2021.

XII. Additional information

  1. The hotel day starts at 16:00
  2. The hotel day ends at 12:00
  3. The invoice for the stay should be settled in advance or before the planned end date of the stay; however, the billing period shall not exceed 7 days.
  4. Online payments are processed by Przelewy24.
  5. If the Service Recipient wishes to book an appointment for services provided by the Medi.SPA Hotel St. Bruno treatment rooms or by the Biblioteka Restaurant or the Club, the Service Recipient will place the relevant information in the contact form on the Hotel St. Bruno website. The Service Provider will contact the Service Recipient promptly, sending a confirmation of the appointment and providing necessary information about the additional services.
  6. Any disputes related to the services rendered by the Hotel, if an agreement between the Service Provider and the Service Recipient cannot be reached, shall be settled by a court competent under procedural regulations.
